Terms and Conditions

These terms govern your use of shop.swizzwatches.com and every order placed on it. They are written to be read. Last updated 11 September 2026.

1. Who you are dealing with

Legal name: GradeGuard, a sole proprietorship.
Principal geographic address of the business (and its only branch): Shop No. 123, 1st Floor, Regency Road, Vibhuti Khand, Gomti Nagar, Lucknow, Uttar Pradesh 226010, India.
Website: shop.swizzwatches.com
E-mail: contact@swizzwatches.com
Fax: not maintained.
Grievance Officer: Kuldeep Patel, Proprietor, at the address and e-mail above. Full details and clocks: Grievance Redressal.

Rule 4(2), Consumer Protection (E-Commerce) Rules, 2020: an e-commerce entity shall prominently display its legal name, the principal geographic address of its headquarters and all branches, the name and details of its website, and contact details including e-mail address, fax, landline and mobile numbers.

GradeGuard is an inventory e-commerce entity: we own the goods we sell. This is not a marketplace, there are no third-party sellers, and there is nobody else to blame if something is wrong. Rule 7(3) of the same Rules makes an entity that vouches for the authenticity of the goods it sells liable for that authenticity. We vouch, and we accept the liability.

2. What we sell

  • Every device on this site is used and refurbished. None of it is new, none of it is sealed by the manufacturer, and we never describe it as either.
  • Cosmetic condition is stated as a grade against our published grading standard, with the named flaws for that unit written out.
  • Stated values — the grade, storage, colour and named flaws, and for laptops the battery wear — are printed on the product page.
  • Photographs on a listing may be of another unit of the same model and grade. The written condition data always describes the unit you receive.
  • Warranty is ours, not the manufacturer’s. Apple, Samsung, Dell, HP, Lenovo and others do not service refurbished units sold by us. See Warranty Policy.
  • Brand names and model numbers are used only to identify what a device is. We are not an authorised dealer, reseller or service provider for any of those brands and we claim no affiliation with them.

3. Price and payment

  • All prices are in Indian Rupees and are inclusive of all applicable taxes. No tax line is added at checkout.
  • The single total figure shown on the product page is the entire amount payable. Delivery ₹0, COD collection ₹0, handling ₹0. That is the complete breakup required by Rule 7(1)(e).
  • Cash on delivery is the only payment method. No advance payment, no card, no UPI, no wallet, no EMI. We will never ask you to pay anything before the parcel is in your hands.
  • Prices can change at any time. The price that binds is the one displayed when your order is confirmed. We do not raise a price after you have ordered, and we do not manipulate prices to gain unreasonable profit or discriminate between consumers of the same class — Rules 4(11) and 4(12).
  • Obvious pricing errors. If a listing shows a figure that is plainly wrong — a decimal in the wrong place, a flagship at a two-digit price — we may cancel the order rather than fulfil it. We will tell you the same day, with the reason, and you will have paid nothing.

4. Placing an order

  • Adding an item to the cart is not a contract. The contract forms when we confirm your order by e-mail after the verification call.
  • Stock is shared with the physical shop in Lucknow. A listing can sell out between your order and our confirmation. If that happens we tell you the same day and offer the nearest equivalent or a straight cancellation.
  • You must be at least 18 and legally able to contract. If you are under 18, an adult must place the order.
  • The address and phone number you give must be yours and must be correct. A COD parcel to a wrong address is the most expensive mistake on this site, and it is the one we cannot fix after dispatch.
  • Consent is never assumed. No box on this site is pre-ticked and no consent is inferred from your having continued to browse — Rule 4(9).

5. Delivery, returns, cancellation and warranty

These are set out in full on their own pages and form part of these terms:

6. Your account

An account is optional; you can check out as a guest. If you create one, you are responsible for keeping the password to yourself and for anything done through it. Tell us immediately at contact@swizzwatches.com if you think someone else has access. You can ask us to close your account at any time and we will, subject to keeping the invoice records that tax law requires us to keep.

7. Reviews

Only customers with a verified purchase of that product can leave a review, and every review is published as written unless it contains abuse, personal data or something unlawful. We do not write reviews of our own products, we do not pay for reviews, and we do not delete a review for being negative — Rule 7(2) forbids an inventory e-commerce entity from falsely representing itself as a consumer and posting reviews about its own goods. If you find a review you believe is fake, report it and we will investigate and tell you what we found.

8. Using this website

Do not scrape it, do not attempt to break it, do not place orders you do not intend to accept, and do not use it to impersonate anyone. All text, photographs, the grading standard and the check sheet on this site are ours; you may quote a short extract with a link, but you may not republish a page.

Where this site carries advertising, it appears only on editorial pages such as guides and articles. There is no advertising anywhere in the shop, cart, checkout, order-tracking or account pages. Adverts are supplied by third parties and are not our recommendations.

9. Liability

We are responsible for the device being what the product page said it was, for the replacement window, and for the warranty. We are not responsible for data you lose — back up before you send a device in for service — nor for loss of profit or business, nor for a delay caused by a courier, a strike, a natural event or a government order.

Our total liability for any order is limited to the amount you paid for it. Nothing in these terms limits your rights under the Consumer Protection Act, 2019, and any clause that would do so does not apply to you.

10. Complaints

Every complaint gets a ticket number you can track it with — Rule 7(1)(f). Acknowledgement within 4 working hours; resolution within 12 days. The statutory maximums under Rule 4(5) are 48 hours and one month; we work to the shorter clock on purpose. Named officer, escalation ladder and the National Consumer Helpline route: Grievance Redressal.

11. Privacy

What we collect, why, how long we keep it and what you can demand of us is in the Privacy Policy, written against the Digital Personal Data Protection Act, 2023.

12. Changes, law and jurisdiction

We may update these terms. The version that applies to your order is the one published when the order was confirmed, and we keep dated copies. Material changes are announced on this page with the date at the top.

These terms are governed by the laws of India. Courts at Lucknow, Uttar Pradesh have jurisdiction — except that, as a consumer, you retain your statutory right under Section 34(2)(d) of the Consumer Protection Act, 2019 to file before the District Commission where you reside or work. That right is yours, not ours to contract away.
